ELCHE CF sells « merchandising » remotely from the club itself. This is what we will call « The Service » from now on. « The User » is the person who browses the web without using the Services. « The Client » is the User who, in addition to browsing the Website, uses the Services. In these cases, we assume that the Client acts as an end consumer and does not resell these products.

4. Geographical scope of the Service

Our Service covers the entire national territory, Ceuta; Melilla, the Balearic Islands and the Canary Islands. At the moment we do not send outside the national territory, so any order outside this geographical area will not be admitted by ELCHE CF and communicated by the Client.

5. Minors

To navigate the Website you do not need to have any age requirement. However, for the contracting of the Service it will be necessary for the Client to be over 14 ( fourteen ) years.

6. Entry into force of the General Contracting Conditions

The General Contracting Conditions will enter into force since the request for the Service made by the Client is considered valid. The request made by the Client will be made through the express and unreserved acceptance of these General Conditions, acceptance that is considered an essential condition for the provision of the Service contracted by ELCHE CF and that will occur if any of the following events occurs: ( i ) the Service request made via the web; ( ii ) the payment of the corresponding invoice or charge and ( iii ) as well as any other action that implies the use of the Service by the Client. The application must be considered valid if all the data of the contracting request have been completed correctly and the Client has accepted these General Conditions.

7. Duration

The provision of the Service will depend on the type of item chosen and the shipping address. In any case, the delivery of the product will be made within 8 to 10 business days from the moment the order is confirmed if the delivery of the order is made within the Peninsula.

In case we do not have stock of the item and we have to request it, ELCHE CF will inform the Client by email that his order will be delayed and the Client will be able to choose to cancel his order without being able to charge any cost.

8. Fees

ELCHE CF will charge the Client for the provision of the Service the rates that ELCHE CF has in force at any time in its commercial offer, which will be available to the Client on the Website to which the Client avails himself when contracting the Service. The current rates, prices, discounts and applicable taxes are broken down according to the products purchased.

Variations in taxes that may be legally applicable to the Client, which will enter into force on the date legally established, will not be considered modifications to the rates.

Within the national territory, the fees will be applied to the taxes that the Client is obliged by law to satisfy, without ELCHE CF being forced to pay fees, taxes or charges derived from the activity of the Client or required by any Official Organism or Professional College. For these purposes, the Client, among others, the payment of the Value Added Tax ( or that other tax of a similar nature that replaces it ) corresponding to each concept of tariffs is obligated.

9. Billing and means of payment

ELCHE CF will charge the Client for the provision of the Service, the fees and prices according to the rates and conditions described in these General Conditions and in the commercial offer in force on the Website. In accordance with the latest legislative developments, electronic invoices are valid for all purposes, so ELCHE CF will not issue any invoice in paper format.

The Client will pay the amounts accrued for the provision of the Service through the payment gateway of the corresponding financial institution.

10. Terms of use of the Service

The Client will use the Service as the final consumer. Customer may purchase the products as offered on the Website or, in some cases, may purchase those products with personalization. Said personalization will be requested by the Client and may consist of the printing of letters and / or images on the products.

eleven. Warranty and return policy

If the product is not in accordance with the contract and / or the product specifications, the Client has two years to exercise the guarantee, in accordance with Royal Legislative Decree 1/2007, of November 16, which approves the consolidated text of the General Law for the Defense of Consumers and Users and other complementary laws

Likewise, the Client will have a period of seven days from receipt of the order to resolve the contract and return the purchased product. In these cases, ELCHE CF will return the purchase money through the same form of payment made by the customer.

As an exception, all those products made according to the Client’s specifications or clearly personalized may not be returned. Nor may those products that are not in good condition and do not keep their original box or packaging be returned.

The costs of returning the product object of the Service will be borne by ELCHE CF. The Client will notify ELCHE CF within the stipulated period of his return by email to ELCHE CF.

12. Service Cancellation

ELCHE CF may immediately terminate the Service and these General Conditions by means of communication made by the means established in the following condition, if any of the following cases occur, without prejudice to those other cases provided for in these General Conditions:

(1) Cessation of activities;

(2) Non-compliance by the Client with the obligations provided for in these General Contracting Conditions;

(3) In cases of force majeure and fortuitous event;

In the event that the terms of the enabling title for the provision of the Service are modified, or it is revoked or renounced for any reason, These General Conditions will be resolved immediately, without any compensation to the Client for the modification, revocation or resignation of the enabling title or for the aforementioned resolution. If there is any pending and not yet sent Service request, ELCHE CF will return the purchase money through the same form of payment made by the Client.

13. Communications

Any communication that must be made by ELCHE CF to the Client that refers to these General Conditions will be made to the address or email indicated by the Client through the Website.

For any communication that must be made by the Client to ELCHE CF in relation to these General Conditions, it will serve as a means of notification:

14. Exclusion of responsibility of the Service

ELCHE CF excludes, to the full extent permitted by the legal system, any responsibility for damages of any nature that may be due to the presence of viruses or the presence of other elements on the Website and the Services that may produce alterations in the computer system, electronic documents or files of the Users.

ELCHE CF excludes any liability for typographical error related to the price or characteristics of the product. However, in the event of an error of this type and the Client has contracted a Service, ELCHE CF will contact the Client as soon as they notice the error to either correct it or offer an equivalent Customer Service.

ELCHE CF excludes any responsibility related to the personalization of the products by the Client, especially those related to misspellings, typographical errors, lack of quality in the image of photography.

These General Contracting Conditions, including the Service rates, may be modified by ELCHE CF at any time, for technical, operational, economic, service or market reasons, prior communication to the Client in accordance with current legislation. The Client accepts that the Service may be modified if a legal or regulatory provision so requires, and ELCHE CF will inform them if it is affected.

The current General Contracting Conditions will always be available through the Website at the bottom and will always be visible from any page of the Website.

16. Privacy Policy

ELCHE CF and the User and / or Client, expressly waiving any other jurisdiction, they are submitted to that of the Courts and Tribunals of the User’s domicile for any controversy that may arise from this Legal Notice and General Contracting Conditions.
